TeeYour provides users with an automated, internet-based service to design and sell custom t-shirts and other personalized products. By accessing or using TeeYour and its services, you agree to the terms outlined in this Agreement and are bound to use the site and services solely as specified herein. For further clarification on these Terms of Service, refer to TeeYour’s Frequently Asked Questions section.
USER AGREEMENT
If you violate this User Agreement in any manner, TeeYour may immediately remove your campaign(s), forfeit any potential profits, and suspend or terminate your account.
TeeYour provides its website and related services to you ("Seller" or "you") under the terms of this User Agreement (the "Agreement"), including the Intellectual Property Complaint Policy, Counter-Notice Policy, Repeat Intellectual Property Complaint Policy, Refund Policy, and Privacy Policy (together, the "Terms of Service"). All obligations set forth in these policies are incorporated by reference.
Delivery Procedure
The delivery time quoted is an estimate only. TeeYour will use commercially reasonable efforts to ensure timely delivery of merchandise by the stated delivery date. Any delays in shipment do not absolve the seller of their obligations under this Agreement.
Print Variance
Product production is based on the artwork uploaded by the seller. The estimated positioning of the artwork is provided by the seller, but print size, location, and colors may vary depending on product size. If stock becomes an issue, TeeYour may substitute comparable products. TeeYour does not guarantee exact print size, location, or colors.
Price and Payment
The seller determines the merchandise price for each campaign. TeeYour will retain customer payments, establish the base price to cover costs (including fees deemed necessary under this Agreement), and remit any remaining amount to the seller as "Seller Profits."
BY CREATING A CAMPAIGN ON THE SITE:
- You agree to adhere to TeeYour’s Terms of Service in their entirety.
- If you are using trademarks, service marks, or copyrights licensed to you (the "Licensed Rights"), you agree to follow any restrictions or conditions placed on their use.
- You affirm that you own or are licensed to use any artwork or text uploaded, including any trademarks or copyrights associated with the material. If you are not the owner, you agree to provide TeeYour with evidence of permission from the rights holder.
- The description and title of your campaign, along with text and images, must not infringe upon the rights of third parties.
- TeeYour reserves the right to remove any content that may promote hate, violence, racial intolerance, or the exploitation of crime.
- TeeYour may release your contact information to a third party if they satisfactorily allege, under TeeYour’s Intellectual Property Complaint Policy, that you have infringed their intellectual property rights.
- Upon receipt of a valid infringement allegation, your campaign may be immediately canceled, your profits forfeited, and your account suspended or terminated.
- You agree to provide truthful information in your campaign and not mislead buyers.
- You will not solicit potential buyers for anything beyond the primary merchandise.
- You agree to indemnify and hold TeeYour and its affiliates harmless from any claims, damages, costs, or expenses arising from your use of the site, violation of this Agreement, or infringement on others' rights.
INTELLECTUAL PROPERTY COMPLAINT POLICY
TeeYour provides users a platform to sell custom products. Users agree to refrain from selling products that infringe upon third-party intellectual property rights. TeeYour will remove any content believed in good faith to infringe on intellectual property rights upon receiving a compliant notice and terminate service for repeat infringers.
To report an infringement, contact support@teeyour.com and provide the following:
- A signature of the person authorized to act on behalf of the rights holder.
- URL(s) to the infringing campaign(s).
- Proof of ownership of the rights being infringed.
- Your contact information.
- A statement affirming your belief that the material is unauthorized.
- A declaration under penalty of perjury that your claim is accurate.
COUNTER-NOTICE POLICY
If you believe a claim of infringement was made in error, you may file a counter-notice by emailing support@teeyour.com with the following information:
- Your signature.
- Your contact information.
- Identification of the removed material.
- A statement that the removal was in error.
- Your consent to jurisdiction in federal court.
- Your consent to accept service of process from the complaining party.
REPEAT INTELLECTUAL PROPERTY COMPLAINT POLICY
TeeYour reserves the right to terminate accounts that repeatedly infringe intellectual property rights or violate the spirit of the Terms of Service.
WITHHOLDING AND TAX MATTERS
TeeYour may withhold applicable income taxes from any Seller Profits if legally obligated to do so. Sellers are responsible for their own tax liabilities and must indemnify TeeYour for any tax obligations arising from this Agreement.
INDEMNIFICATION
Sellers agree to indemnify, defend, and hold TeeYour and its affiliates harmless from any claims arising from (i) content submitted by the seller, (ii) use of TeeYour’s site, (iii) violation of this Agreement, or (iv) infringement of third-party rights. TeeYour may exercise its rights as a secured party to Seller Profits if necessary.
LIMITATION OF LIABILITY
TeeYour's liability to the seller is limited to the amount of Seller Profits owed. TeeYour is not responsible for consequential or special damages, including lost profits, arising from use of the service or breach of contract.
DISCLAIMER OF WARRANTIES
TeeYour provides the service "as is" and disclaims all warranties, express or implied, including those of merchantability and fitness for a particular purpose. Buyers have the right to return merchandise as outlined in TeeYour’s Return Policy.
EXPLOITING SYSTEM VULNERABILITIES
TeeYour reserves the right to address individuals or organizations that exploit system vulnerabilities. Those who do so must compensate for damages caused, including financial losses and system disruptions.
MISCELLANEOUS PROVISIONS
- Assignment: Sellers may not assign rights or delegate obligations without prior consent. TeeYour may do so at its discretion.
- Severability: Invalid or unenforceable provisions do not affect the enforceability of the remaining terms.
- Governing Law: This Agreement is governed by Florida law, and disputes are subject to the jurisdiction of Hillsborough County courts.
- Waiver of Jury Trial: Both parties waive the right to a jury trial for any legal action arising from this Agreement.
PAYMENT, RETURNS, REFUNDS, AND CANCELLATIONS
Buyers are charged at the time an order is placed. Products are custom-made, so TeeYour does not accept cancellations, exchanges, or refunds except in cases of incorrect orders due to TeeYour’s error.
